SC suggests punishment to
"martial laws" perpetrators
The Supreme Court has upheld the High Court verdict that scrapped the 5th Amendment of the Constitution suggesting "suitable punishment" to perpetrators of martial laws. The August 2005 High Court judgment had rendered illegal the regimes of martial dictators Ziaur Rahman, Khandaker Moshtaque Ahmed and Abu Sadaat Mohammad Sayem between August 15, 1975 and April 9, 1979. The Supreme Court in its observations and modifications also upheld the basic principles of the 1972 (original) Constitution including Bangali nationalism and socialism but also recognized citizens of Bangladesh as Bangladeshis.......Total News

The Appellative Division has justified the retention of Article 6 (2) inserted in the Constitution by the 5th amendment that says the citizens of Bangladesh shall be known as “Bangladeshis”.Late President Gen Ziaur Rahman through a martial law proclamation had changed the identity of Bangalees as envisaged in the original Constitution of 1972. “For wider public interest the substituted Article 6 (2) is to be retained,” the Appellate Division said in its modification of the High Court judgment that scrapped the 5th amendment. ...
